Terms of Service

Effective date: September 11, 2025

These Terms of Service ("Terms") govern your use of the Contestant Voting service provided by InfoTek Perspective Services ("InfoTek", "we", "us"). By subscribing or using the platform, you agree to these Terms.

1. Services

We provide a voting platform that provisions unique Virtual Bank Accounts (VBAs) per contestant, converts incoming transfers into votes, and provides real-time leaderboards, reporting and payout functionality.

2. Subscription & Fees

• Annual Subscription: ₦250,000 (Naira) — allows the owner to run unlimited voting competitions for 12 months from the activation date.
• Subscription renews annually. Continued access to the service requires timely renewal.
• All fees are non-refundable except when required by law or where we explicitly agree in writing.

3. Revenue Share & Payouts

• Collected funds from voter transfers are subject to any bank or payment gateway charges. Net collections are split as follows: 60% to the Owner (subscriber) and 40% to InfoTek.
• Withdrawals: Owners may request payout of their available balance at any time through the dashboard. Requests are processed subject to standard bank processing timelines and any partner restrictions.
• We will provide transaction logs and reports to support reconciliations.

4. Voting rules

• Unit vote price must be chosen from the allowed set: ₦30, ₦50, ₦100, or ₦200 per vote.
• Votes are calculated as: floor(transfer_amount ÷ unit_price). Any leftover balance from a transfer is recorded as credit to the contest owner and included in payouts unless otherwise stated.
• We reserve the right to suspend or disqualify contestants or contests if fraudulent activity or rule violations are detected.

5. Account & KYC

To use the platform, owners must provide accurate contact information and, where required by our banking partners, KYC documents (government ID, proof of address, CAC registration for companies). Failure to provide KYC may delay account activation or limit withdrawal capability.

6. Intellectual Property

All platform software, graphics, and content are the property of InfoTek or our licensors. Owners retain rights to their uploaded content (contestant images/descriptions) but grant InfoTek a license to display and use that content for the purpose of running the service.

7. Refunds & Cancellations

• Subscription fees are generally non-refundable. If we terminate your account for cause, we may withhold certain funds pending investigation.
• Owners may cancel auto-renewal. Cancellation does not entitle the owner to a pro‑rata refund for the unused period unless agreed in writing.

8. Limitation of Liability

To the fullest extent permitted by law, InfoTek shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from the use of the service. Our maximum aggregate liability for direct damages shall not exceed the subscription fees paid by the owner in the prior 12 months.

9. Indemnification

You agree to indemnify and hold InfoTek harmless from any claims, losses, damages, liabilities, and expenses arising from your breach of these Terms or misuse of the service.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute shall be subject to the exclusive jurisdiction of the courts of Nigeria unless the parties agree to arbitration.

11. Changes to Terms

We may modify these Terms from time to time. We will provide notice of material changes to account holders. Continued use after changes constitutes acceptance.
